Upon hearing this, Mr. Hughes Hughes gave up the vote, upon the ground that he would not sanction any disrespect to the Lord Mayor. Vote disallowed. Lupton, John, 53, Bread Street. Objection--That the voter was made free of the city of London, within 12 months antecedent to the election. Bompas, Serjeant, opened this case. The decision upon the case of this voter, would be most important, inasmuch as it would in its effect, regulate the whole municipal franchise of the city of London. He contended that under the 11th George 1, ch. 18, the election to the aldermanic gown must be considered not to be vested in persons made free only an hour before the contest, but in freemen who had been free 2 months previous to the Hughes. Lawrence. election, and who had inhabited and paid their scot and borne their several and respective lots, as the act required, and for the like period. In that view he was borne out by the words of the Recorder himself, who, in the opinion he had offered to the corporation of London, had declared the franchise to be vested in "a freeman" who had been in the occupation of a distinct tenement, &c, for 12 calendar months prior to the election. First, as to the act--It was passed to prevent "a manifest violation of the rights and privileges of the citizens," (or, in other words, of the freemen,) at a time when it was the practice, as it had been unfortunately at this election, to make occasional voters for a particular and not a very worthy purpose. If the act failed in accomplishing that design, it was worthless, and unless it insisted that the freemen should be so for 12 months antecedent to the poll, he confidently submitted that it did so fail.
