Not illustrated. 1817 Excerpt:...certificate, is a useful and £ W.Surei, Esq. judicious change in the law?--I think the law as it originally stood was to be pre-J ferred; and I would suggest the propriety of enabling the commissioners, if they saw fit, to order some allowance to be made to the bankrupt and his family during the time of the operation of the commission, and until a month after the passing of his examination, for at present it is a lamentable case; assignees are constantly in the habit of doing it, but they do it at their own risk and periL With respect to the certificate of the honest bankrupt, I have conceived, myself, that if the commissioners certify his good character, that at the expiration of a certain term he should be entitled to his certificate, even if the creditors did not sign it to that extent. Would you have that mark of his good character notified in terms in the Gazette, to distinguish him from fraudulent bankrupts?--Yes. I have already stated that certificates should be recorded in the bankrupt office, to which every person might resort; and I think it would be beneficial to the public, if the character of an honest bankrupt were publicly proclaimed in the Gazette after he had passed such an ordeal. Would you hold that person to be the honest character you speak of, against whom the creditors should not have required that investigation to be made of his conduct which you have spoken of in a former part of your examination?--Certainly I should, because the absence of any complaint would pre-suppose the propriety of his conduct.
