"In this course, Professor Mani, director of the Gujarat National Law University, seeks to examine the rationale, real or fancied, of the new claim to the use of armed force for "humanitarian" purposes such as to halt or prevent gross violations of human rights in a State that has failed to respond to the situation or has failed to set it right. Thus, Professor Mani examines the concept of "humanitarian" intervention, mainly through the various doctrines and practices relating to war in general and situations of permissibility of war in particular. Professor Mani then examines the response of contemporary international law (the presence of the United Nations, the impact of the emergence of jus cogens on rights and duties of States, new doctrines that positing human rights against the concept of State sovereignty and justifying the doctrine of "just" war doctrines.) In the last chapters Professor Mani examines the juridical aspects of the new claims of "humanitarian" intervention by States in justification of unilateral resort to force by them, and the legal aspects of the role of the United Nations in mounting institutional "humanitarian" action"--Publisher's description.
