Excerpt from History of a Suit in Equity, as Prosecuted and Defended in the Virginia State Courts and in the United States Circuit Courts The arrangement of the work, as originally published, has been preserved, with this exception, that much of the matter found in the Appendix of the first edition has been placed in the body of the present. The first part of the treatise, embracing the first book, traces the history of a suit in equity from its beginning until the entry of the final decree and its execution. The discussion of Inter locutory matters, Issues out of Chancery, Proceedings before Commissioners, Injunctions, and Bills other than original bills will be found in the second book. In the Appendix, I have placed the Rules of Equity Practice in the United States Circuit Courts, and have treated of the Doctrine of Parties in those courts and of other matters deemed important. The chapters on Evidence: in Equity, pp. 399 - 501, and on Demurrers, Pleas and Answers, pp. 161 - 382, have been much enlarged. There seemed to be need for this.
