
To this day, international sports law has passed for not having been thoroughly examined and disclosed. Among other things, it seems not to be known that international sports law is not a phenomenon of the late 20th century, but that it has its roots in the Ancient World. Furthermore, there still is disagreement as to the meaning of the term international sports law. Moreover, to date there has not been paid any attention to public international sports law. It is generally known that international sports law is in a »dilemma«: sport is being practised more and more on an international base, but the corresponding law applied is basically national. This leads, on the basis of relatively equal terms and depending on applicable national law, to varying results – a state of affairs that is diametrically opposed to the principle of equality inherent in sport.The objective of this study is to contribute to the disclosing of international sports law. To this end, the author shows the long history of international sports law, and gives its concept a new understanding and meaning. Moreover, special consideration is given to the discipline (so far »forgotten«) of public international sports law, whose development is traced back, and whose »fields of activity« are shown and assessed. Furthermore, this study goes intensively into the »dilemma« of international sports law by critically analysing existing hints of solutions and by giving these hints further development. In the hope of thereby yielding a profit to sports law in everyday practice, the author eventually tries to contribute – by means of public international sports law – to the resolution of the »dilemma«.
