This revised version discusses the extensive modifications, that were introduced by the Law to modernize Contract Law and by laws reforming Labor Law and Social Law. Here it becomes ever more apparent that Labor Law in relation to Civil Law is by no means an independent legal institute, governed by its own specific principles and rules of interpretation. The same goes for the application of European Law. The comments therefore do not constrain themselves to explaining legal regulations, instead they incorporate the entire body of labor law, especially the field of collective bargaining agreements (on tariffs, labor disputes and industrial relations). This volume contains extensive comments on the ban on gender related discrimination of employees before the background of the new European guideline EG 2002/73 as well as other anti-discriminatory guideline. The law on the conveyance of companies and similar problems from the area of restructuring of companies is also treated in detail. Following the overall concept of the Staudinger, this volume too offers an encyclopedic treatment of the topic - here in particular labor law. Being more than a documentation of relevant legislation and judiciary decisions, it reports on the results of decisions, arguments and counter arguments and proposed solutions to legal problems.
