Employment Law introduces the issues involved in the regulation of employees and their relations with their employers. It explains the framework governing employment contracts, dismissal procedures and redundancy payments. The book also covers TUPE, discrimination law and family-friendly legislation, as well as practice and procedure. The book has been comprehensively updated to take account of all the main recent and proposed developments in employment law and practice, including the implications of Brexit, an introduction to the General Data Protection Regulation and the Data Protection Act 2018 in an employment context. Updated sections on the gig economy and zero hours contracts have been added, covering all the recent cases on workers, including the Supreme Court decision in Pimlico Plumbers Ltd v Smith, along with a useful summary of the key cases on paid annual leave. The section on public interest whistleblowing disclosures has been revised and updated. The comments of Lady Hale in the Supreme Court decision in Reilly v Sandwell MBC on the application of the so-called Burchell unfair dismissal test in s 98(4) ERA are considered. Also included are the Supreme Court cases of Newcastle upon Tyne Hospitals NHS Foundation Trust v Haywood, (which identified the existence of a standardised implied term when giving written notice of dismissal that written notice runs from the date it is read, or if earlier, the date one had a reasonable opportunity of reading it) and MWB Business Exchange Centres Ltd v Rock Advertising Ltd (on contractual variations). A number of important new European Court of Justice decisions are explored, including King v The Sash Window Workshop Ltd. (the right to paid holiday) and Ville de Nivelles v Matzak (working time for standby firemen).
