Judge Landis in. the Federal Court at Chicago on May 29, 1913, granted permission to the Bankers Trust Co., New York, and Scott, Brown & Co., South Bend, Ind., to file suit for foreclosure of the improvement and refunding general mortgage. Later he granted leave to consolidate the suit with that brought by the American Brake Shoe & Foundry Co. filed in April, 1912, m which receivers were appointed. A bill to foreclose the Consolidated mortgage was filed in the Federal Court at Detroit in April, 1914. Suit to foreclose the refunding mortgage was filed in the Circuit Court at Detroit on Oct. 21, 1914, and in the United States District Court at Indianapolis, Ind., on Jan. 18, 1915. Judge Arthur Tuttle, in the U. S. District Court at Detroit on July 22, 1915, ordered the sale of the property under foreclosure of the consolidated mortgage of 1901. Upset price, $14,000,000, subject to underlying bonds and interest, which virtually brings the price to about $42,000,000. On Oct. 7, 1915, Judge Carpenter, at Chicago, 111., entered an. order approving the foreclosure and sale, as set forth in a decree entered in the Federal District Court at Detroit, Mich., on July 22, 1915. Judge Arthur Tuttle, in the United States District Court at Detroit, on Dec. 20, 1915, fixed April 5, 1910, as the date for the sale of the company to satisfy creditors Date of sale of the road was postponed from time to time and road was finally sold in March. 1917.
